    THURSDAY APRIL 4 – WEDNESDAY MAY 1

    1. Information on how to enter and the prizes form part of these conditions of entry.  Participation in this competition is deemed acceptance of these terms and conditions. If you do not accept these conditions, you must not enter.
    2. The Promoter is Tenfold Hospitality Group (The Ashby Bar & Bistro)
    3. The promotion commences at 9.00am AWST on Thursday, April 4 2024, and closes at 11.59pm AWST on Tuesday 30 April 2023. (Promotion Period).
    4. Entry is open to any person aged 18 years and over who:
    1. resides in Western Australia
    2. is a Tenfold Loyalty member (buy a pint of Carlton Dry & tap their Tenfold Loyalty card at The Ashby Bar and Bistro during the Promotion Period)

    Failure to comply with any of the above requirements in this clause 4 will automatically render an Entry to be invalid.

    1. Incomplete, indecipherable or illegible entries will be deemed invalid. Employees and their immediate families, of the Promoter, related companies of the Promoter or agencies associated with this promotion are ineligible to enter.
    2. Entries are deemed to be received at the time of entry into the promotion draw. The Promoter is not responsible for any delay or failure of transmission of any Entry.
    3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants and to disqualify any entrant who manipulates, or attempts to manipulate, the system.
    4. One winner, that complies with all entry requirements, will be selected by the Promoter in accordance with Clause 9 below, to receive the prize, which consists of the following elements:
    • Return economy flights for two people between Perth and Melbourne on board the round 15 West Coast Eagles charter flights, (departing Perth on Friday, June 21, 2024 at approximately 12.00pm AWST and returning on Sunday, June 23, 2024 at approximately 7.30pm AWST), including 1 x 7kg carry-on bag per person (please note: flight times may be subject to change without notice at the absolute discretion of the airline and it is the Winner’s responsibility to ensure that they are on time for any and all flights. All flights included in the Prize are subject to Virgin Australia’s Conditions of Carriage available on their website at https://www.virginaustralia.com/au/en/about-us/policies/legal/conditions-of-carriage/ );
    • Two nights accommodation in a Twin Share Room (being Friday, June 21, 2024 and Saturday, June 22, 2024) in Melbourne at a location to be determined;
    • Two match tickets in a Private Suite, (with food and beverage catering included) at the Round 15 AFL Fixture between Melbourne and North Melbourne played at the MCG, Saturday, June 22, 2024;
    • Two Premium Hospitality match tickets (seat only, no catering included) at the Round 15 AFL Fixture between Essendon and West Coast Eagles played at Marvel Stadium, Sunday, June 23. 2024; and
    • Two provided breakfasts (being Saturday, June 22, 2024 and Sunday, June 23, 2024) at locations to be determined.

    (Collectively known as the Prize)

    1. The winner will be, the first valid Entry selected by the Promoter at random on Wednesday, May 1 at 7:30 pm held at The Ashby Bar and Bistro (131 Pinjar Road, Ashby, WA 6065) that complies with all requirements as set out in these terms and conditions, and will be notified by the contact details provided in their loyalty membership (Winner). The Promoter reserves the right to select reserve entries and record them in the order that they were selected, in case of an invalid or ineligible entrant being selected. For the avoidance of doubt, only one Prize will be awarded.
    2. 10.Once one Winner has been selected by the Promoter, no further prizes will be awarded.
    3. 11.The Prize, or any unused portion of the Prize, is not transferable to another date or person if the winner is unavailable on the specified date. The Prize is not able to be exchanged for cash or alternative benefits. Should the winner not meet the check-in and boarding requirements for either or both flights, the tickets will be forfeited.
    4. 12.The Promoter reserves the right to request that the winner provide proof of age and identity prior to awarding the Prize. Identification considered suitable for verification is at the discretion of the Promoter.  The Winner may be required to sign any form required by the Promoter including, without limitation, a legal release and indemnity form or a declaration confirming their eligibility to accept the prize.
    5. 13.The Winner and their guest are required to comply with any and all reasonable requirements and instructions of the Promoter, the West Coast Eagles, Marvel Stadium and the MCC. Any failure by the Winner, or their guest, in the reasonable opinion of the Promoter, the West Coast Eagles, Marvel Stadium or the MCC to comply with their reasonable requirements or instructions may result in forfeiture by the Winner of any part or all of the Prize.
    6. 14.The Promoter is not responsible for any costs incurred by any Winner (or their guest) in collecting or using the Prize (or any portion of the Prize) including without limitation baggage fees, food and beverage costs or any other fees or charges incurred by the Winner (or their guest) at any time.
    7. 15. The Promoter’s decision will be final and cannot be contested. No correspondence will be entered into.  The Promoter reserves the right to limit entry or amend rules if considered necessary without notice.
    8. 16.The Promoter and its associated agencies and companies (and their respective officers, employees and agents) will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this promotion or accepting or using any Prize (or part of the Prize), except for any liability which cannot be excluded by law (in which case that liability is limited to the maximum extent permissible by law).
    9. 17. If for any reason this promotion is not capable of running as planned, including but not limited to fraud or causes beyond the control of the Promoter or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in their sole discretion to cancel, terminate, modify or suspend the promotion.
    10. 18. the Prize (or any element of the Prize) may not be sold or offered for resale at a premium (including via-online auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services, either by the original recipient or any subsequent bearer.  If a Prize is sold or used in breach of this condition the Prize may be withdrawn.
    11. 19. By participating in this promotion, entrants agree to the Promoter using and disclosing the entrant’s personal information for the purposes of conducting the promotion, redeeming the Prizes and any other matter connected to or incidental to this promotion. Entrants consent to their information being used by the Promoter and its related companies for the purposes of carrying out marketing, planning, product development and promotional campaigns in any media including email and SMS.
    12. 20. In the event that they are the Winner (or their guest), entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion and for any other purpose at the Promoter’s sole discretion.
    13. 21. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers and service providers to assist in conducting this promotion or providing the Prize, and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion
    14. 22. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

Terms & Condition

1. FUNCTIONS & EVENTS

1.1 Confirmation of Bookings& Deposits
In order to confirm your event booking, we require a full payment of the quoted minimum food spend. If the deposit and booking are not received we reserve the right to allocate the area(s) to another booking. Final numbers are to be confirmed 5 days prior to your event and full payment is to be received by the agreed date.

1.2 Cancellation
Fees will apply to all cancelled event bookings. Event bookings will need to give 10 days notice to receive a full refund. Any function cancellations that do not give the relevant notice will forfeit the agreed deposit or payment(s) made to the venue.

1.3 Payment
We accept cash, credit card or Eftpos. Direct debit will also be accepted provided a remittance is emailed to the functions coordinator within 72 hours prior to the event. Any outstanding balance will be charged to the credit card provided at the time of booking.

1.4 Minimum Spend/Guest Numbers
We reserve the right to apply minimum food and beverage charges where an area is specifically allocated for an event. We also reserve the right to refuse a function booking or section off an exclusive area(s) based on guest numbers or minimum spend requirements.

1.5 Equipment, Decorations & Entertainment
Please ask our functions coordinator about decorations, entertainment, equipment hire and any special requirements to tailor your event. Extra charges may apply. Items supplied by the Venue may incur extra charges.

1.6 Dress Code
It is a requirement of the event organizer/client that the guests attending the event are informed of the dress code and any requirements. Please refer to our website for further information; theashbybarandbistro.com.au

1.7 Commencement Times
Access to an event or area earlier than the stated start time will require prior arrangement with the venue.

1.8 Ticketed Events, Bookings & Cancellations
All tickets must be paid in full at time of booking unless discussed prior to ticketing. Please choose carefully as no refund will be given for incorrect purchases or change of mind.

1.9 Supply of Alcoholic Beverages
We retain the right to refuse the supply of alcoholic beverages to any guest(s) attending the venue that are underage, intoxicated or displaying suspicious or offensive behaviour. In accordance with in-house policy and the Liquor Control Act 1988.

2.0 Underage Guests
Children must remain seated & with their legal guardians at all times. In accordance with the Liquor Control Act 1988. Curfews do apply in some circumstances. (Unless pre arranged with management.)

2.1 Responsibility
The client is legally responsible for any damage that is sustained to the venue or any other property whilst attending or holding and event.

2.2 Food & Beverage Offerings
Our venue reserves the right to change any of our offerings without prior notice.
